How Does Divorce Mediation Work?
In your Divorce Mediation sessions, Laurie will help you and your spouse work together to pinpoint the difficult issues and find a variety of solutions to accomodate both of your needs. Mediation allows us to be creative and formulate agreements that suit your particular situations. We will provide information, as necessary, to empower you with knowledge to make informed decisions. The mediator is not an advocate for either party. Even though one party may be more powerful or a better negotiator, the mediator helps to balance the power. During mediation other professional services are sometimes needed. We maintain a network of consultants including accountants, appraisers, financial planners, career counselors, psychotherapists and child psychologists.
What Are the Steps Involved? At the first session or over the telephone the mediation process is explained in detail. After this, both of you, with the help of the mediator, begin to discuss your concerns. Then we gather any necessary financial data. Step by step, you and your spouse make decisions about the type of agreement you want. During this process, care is taken to make sure that the needs of all family members are considered.
What Happens After We Reach an Agreement? Once a tentative agreement has been reached, Laurie, the attorney-mediator, will draft the binding Separation Agreement. Although you do not need an independent attorney, you are can have the Agreement reviewed by independent counsel. After final review we will draft the corresponding documents and file the separation or divorce papers in court.
What Does It Cost? There is NO retainer. You pay-as-you-go. The fee is sliding scale, averaging $150/hour. Mediation sessions generally last from one to two hours. They are usually scheduled a week or two apart. While it can take as little as 2 hours, the average length of time it takes to reach an agreement is 6-12 hours. Unlike the court process, mediation does not drag indefinitely. Drafting of the binding Separation Agreement and the filing of divorce papers are separate charges. The cost of mediation can be 90% less than the cost of a litigated divorce in court.
